Relatives of China train crash victims mourn (AP)

WENZHOU, China ? Around two dozen grieving relatives of victims of a high-speed train crash have been laying flowers at the site of the accident that killed 39 people and prompted a public outcry.

The family members gathered Friday at the muddy spot under a viaduct from which four train cars plunged after one bullet train rammed into another that had stalled. They declined to speak to the media.

As a drizzle fell, relatives knelt as they burned incense and paper near a pillar of the viaduct on which a poem mourning the crash victims had been scribbled.

Saturday's accident near the city of Wenzhou has triggered public anger over what caused the crash and the government's handling of the aftermath.

Off-course penguin in New Zealand to be set free (AP)

WELLINGTON, New Zealand ? New Zealand's favorite penguin visitor has been given a health clearance to be returned to the wild. The news comes five weeks after he was found on a beach more than 2,000 miles (3,200 kilometers) from his Antarctic home.

The emperor penguin nicknamed "Happy Feet" has been recuperating at the Wellington Zoo since soon after he was discovered on the North Island. He is the first emperor penguin to be found in the wild in New Zealand in 44 years.

He became ill after eating sand, likely mistaking it for snow.

Zoo spokeswoman Kate Baker said the penguin has gained about 9 pounds (4 kilograms) and this week passed an X-ray and blood test. Baker said the penguin will likely be released offshore from the south end of the country sometime in the next few weeks.

Tense mood as lawmakers struggle for debt deal (Reuters)

WASHINGTON (Reuters) ? A bitter mood prevailed on Capitol Hill as lawmakers struggled on Saturday to find a compromise measure to lift the nation's $14.3 trillion debt limit three days before a deadline to avert a ruinous default.

A day after the Republican-led House of Representatives passed a bill to cut the deficit and raise the debt limit, Democrats who control the Senate pushed ahead with their own deficit-cutting plan.

Scrambling to put together legislation that could attract bipartisan support needed to pass it in the Senate, Democrats incorporated elements of a Senate Republican proposal.

But entrenched differences remained, and back-channel talks held the best hope for a compromise. Unless Congress raises the debt ceiling, the government would be barred from further borrowing after Tuesday, according to the U.S. Treasury, and could quickly run out of money to pay all its bills.

With tensions high, Democrats accused Senate Republicans of refusing to talk to them. Senate Minority leader Mitch McConnell wanted the White House involved to ensure that any final bill has broad Democratic support, aides said.

The debt saga shifted to the Senate late on Friday after the House passed a deficit-cutting bill, breaking weeks of political inertia. The Senate, as expected, quickly killed that bill that would have extended the debt ceiling by just a few months, but its earlier approval by the House lifted hopes that it could form part of a final compromise.

President Barack Obama urged lawmakers to strike a deal and head off what he has said would be an "inexcusable" default.

"There are multiple ways to resolve this problem," Obama, a Democrat, said in his weekly radio address. "Congress must find common ground on a plan that can get support from both parties in the House. And it's got to be a plan that I can sign by Tuesday."

The Senate now is expected to vote on its legislation early on Sunday morning, setting up final passage on Monday morning, shortly before U.S. financial markets open.

In a symbolic move, the House was set to vote at around 2 p.m. EDT to consider the plan crafted by Senate Democratic leader Harry Reid. House Republicans said they expected to defeat that bill because it did not contain enough spending cuts.

"The Senate is burning up precious time by working all weekend on a doomed Reid bill that can't pass the House," a House Republican leadership aide said. The aide said "congressional talks are essentially motionless until Senator Reid provides specifics to the Hill on what the president will sign."

CRUCIAL WEEKEND

With Republicans pushing to have the White House join the talks, Vice President Joe Biden, who has a rapport with McConnell from his years in the Senate, could emerge as a key player in final negotiations.

The world has watched with growing alarm as political gridlock in Washington has brought the world's largest economy close to an unprecedented default, threatening to plunge financial markets and economies around the globe into turmoil.

With its back against the wall, the U.S. Treasury could be forced to detail plans on Sunday before Asian markets open on which bills it would pay if a compromise does not appear to be in the works. Analysts believe it will stop other government spending to ensure bondholders are paid to avert a wide-scale financial crisis.

Senate Democrats' debt-limit proposal, which would cut $2.2 trillion over 10 years, was revised by Reid to incorporate parts of a "backup plan" first proposed by McConnell. Under the that version, Obama would be given the authority to raise the debt ceiling in three stages to cover U.S. borrowing needs through the 2012 elections when he is running for a second term.

The House Republican plan includes a two-stage strategy for raising the debt limit that could set up another showdown over the issue within a few months -- a prospect Obama has said is unacceptable

U.S. stocks endured their worst week in a year as the uncertainty made investors shy away from riskier assets and the dollar slumped to a record low against the safe-haven Swiss franc. Much worse could be in store if a U.S. debt deal doesn't appear to be on track by the time markets open on Monday.

A late deal also raises the prospect of the United States losing its top-notch AAA credit rating, which could rattle markets and raise borrowing costs for Americans struggling with unemployment above 9 percent.

Do You Recognize These Problems With Business Negotiations

Greg Dannis is a lawyer who?s spent a career working with school districts in California. He?s a founding partner at Dannis, Wolver & Kelly, in San Francisco. I just finished reading his article Labor?s Lessons in the California Public Employees Relations Journal.

Greg writes about labor contracts in schools, specifically; he?s been involved in that area for decades. But it occurred to me that what he says about that applies just as well to business negotiations I?ve been in.

For example, how time in negotiations is different from time everywhere else:

I always believed in the immutability of time ? until I experienced negotiations. Bargaining is unreal in so many ways, but I did not anticipate the altered measurement of time itself! This time warp can be calculated between ratios of about 2:1 to 6:1 depending on the activity at hand. For example:

• When the parties agree to take a one-hour lunch break, in negotiations time this signifies an interlude of two hours ? a 2:1 ratio.
• ?We just need a five minute caucus? in bargaining reality means a half-hour ? a 6:1 ratio.
• ?We will respond to your proposal at the next session? may in fact mean you will not see a counter proposal for months, if ever. I cannot even calculate the ratio for this.

Even more astounding is how units of time can be compressed. An eight-hour session can metamorphose magically into six and even four hours! This phenomenon rarely happens in the opposite direction, however, in which the parties actually stay beyond the established ending time.

At another part of the same article, he?s talking about telltale signs of developing problems:

• The Caucus Time/Table Time Ratio. The more time spent away from each other in caucus, the worse the process is working.
• The ?Post-It Index.? At some tables, only the spokesperson is allowed to talk, and team members may contribute only by sending post-its back and forth. In this case, the more post-its that are ?flying,? the more trouble you are in.

These are just a couple of witty interludes in a serious article about the future of public education and the impact of school boards and teachers? unions having to work together. In the end, his conclusion is a lot like what I?ve seen in just about every business negotiation: it?s win-win or lose-lose. No one party beats the other if the conclusion isn?t good for both sides. That?s my way of saying it, but here?s Greg?s conclusion:

We have grave problems to conquer, and if we heed Labor?s Lessons, we can be jointly victorious without either side seeking to be triumphant. We need to reject rigidity and embrace flexibility. For, perhaps the greatest Labor?s Lesson of all is this: The most successful people are those who are good at Plan B.

COMMENTARY | Do you want fries with that? The common questioned asked through a little metal drive-thru speaker was not muttered for a little while in the Chicago area, but has now returned. Bending to pressure from health advocacy groups and supporting lawmakers, McDonald's temporarily pulled french fries from their Chicago area Happy Meals. Outcries from disappointed children and parents prompted a quick return of the famous tasty fries, but in smaller portions. The famed fast food chain is now also adding organically grown fruit and vegetables to the kid-sized meals which come with a small toy.

No adult in their right mind could argue with the benefits of eating healthy and introducing more pesticide free fruit and veggies to their child's diet. But local governments have over-stepped their authority in a growing number of cities across America. The "food police" in Cleveland, San Francisco and now possibly Chicago are taking parental authority out of the equation.

Preschool children do not typically wander into the local McDonald's with their piggy banks and "chow down" on chicken nuggets and salty fries. Non-profit children's advocacy and health groups are entitled to share their views and attempt to educate parents about proper nutrition, but should not dictate governmental policy.

Shame on McDonald's for caving into the loud voices of grant funded organizations. Responding to parent requests for healthy meal substitutes is good business, but altering an entire business model against the wishes of customers may become a financial bottom line issue. The nutritional attributes of the new version of Happy Meals which will be available in specific regions of America are undoubtedly an improvement. Menu offerings will vary depending upon available seasonal fruits and vegetables. Parents can now choose to add a healthy side dish to Happy Meals which include carrots, pineapple slices, mandarin oranges and raisins.

An attempt to add a healthy component to McDonald's Happy Meals in 2006 did not produce the results health advocacy group anticipated. Even though the fast food giant added the option of including "Apple Dippers" in Happy Meals, only 11 percent of customers chose to include the apple slices. You simply cannot legislate or mandate healthy behavior. Forcing restaurants to become defacto parents or dieticians will not solve the childhood obesity problem. Responsible parents will make reasonable food choices for their children, which will likely include the occasional unhealthy meal with a toy.

To truly foster a healthier generation of children, the rising cost of purchasing fresh fruit and vegetables will need to be addressed. Low-income families often choose the $2 frozen dinner or $1 package of Ramen noodles not because they do not care about the health of their children, but because it is all they can afford. County social services agencies who partner with local farmer's markets and offer produce waivers will foster more healthy children than obsessing about the connection between a cartoon themed toy in a fast food kid's meal.

Greece suffers new credit downgrade (AP)

ATHENS, Greece ? Standard and Poor's on Wednesday relegated Greek government bonds to the deeper end of junk status, cutting the debt-crippled country's credit rating by two notches to CC and saying a new downgrade is likely.

The international ratings agency said a proposed restructuring of Greece's debt load under a second international bailout deal worth euro109 billion ($157 billion) would amount to a selective default ? a rating that, while humiliating, is expected to have limited practical consequences. Both of the other major ratings agencies have said much the same.

A Standard and Poor's statement also said the possibility of a future Greek default is likely to remain high.

Under the debt relief deal struck in Brussels last week, banks and other private investors will contribute some euro50 billion ($72 billion) to the rescue package until 2014 by voluntarily swapping Greek bonds that they hold for new ones with lower interest rates or slightly lower face value

"Standard and Poor's has concluded that the proposed restructuring of Greek government debt would amount to a selective default under our rating methodology," the ratings agency said. "We view the proposed restructuring as a 'distressed exchange' because, based on public statements by European policymakers, it is likely to result in losses for commercial creditors."

On Monday, Moody's ratings agency downgraded Greece by three notches and warned that it is almost inevitable the country will be considered to be in default following the new bailout package.

There was no immediate comment from Athens. Responding to the Moody's downgrade, government spokesman Elias Mossialos had said it was of "no practical value," arguing that domestic lenders can now count on secure credit lines.

He also suggested that Greece should cancel its subscriptions to international ratings agencies.

Greece closely flirted with insolvency for more than a year, after profligate government overspending and a massive public debt drew an avalanche of credit downgrades, while the country's borrowing rates were driven so high that access to bond markets became impossible.

But the bailouts have staved off a potentially catastrophic bankruptcy that could have stopped payment of pensions and public sector salaries. While a selective default rating will be a humbling first for a country using the euro, its immediate practical consequences for Greece should be limited.

For weeks, the overriding fear was that, because of the bad rating, already struggling Greek banks would be frozen out of the European Central Bank's emergency liquidity operations.

However, last week eurozone leaders found a way around that threat by promising to temporarily deposit euro35 billion ($50 billion) with the ECB to boost the creditworthiness of defaulted bonds used as collateral by Greek banks, until the default rating has been lifted.

Crucially for Greece and Europe as a whole, the International Swaps and Derivatives Association, a trade association, said the new rescue deal is not expected to trigger payment of bond insurance because private sector involvement is voluntary.

Standard and Poor's said it understands that Greece's debt restructuring will start in September 2011 at the earliest.

"Upon the announcement of the implementation of the restructuring, a downgrade to 'SD' (selective default) would likely occur," the agency said. "If the exchange involves multiple separate transactions over several weeks or months, we would assign our 'SD' sovereign credit rating to Greece on completion of the first repurchase."

"Subsequently, all other things being equal, we would likely raise our sovereign credit rating as early as a few days after completion of the first repurchase."

Despite strong opposition from trade unions and even some of its own lawmakers, Greece's Socialist government has implemented harsh austerity measures for more than a year, cutting pensions and public sector salaries while increasing taxes and retirement ages.

Future measures include an ambitious euro50 billion privatization program by 2015.

Earlier Wednesday, Greece appointed BNP Paribas, Deutsche Bank and HSBC to act as dealer-managers for the voluntary private sector participation scheme.

Cleary Gottlieb Steen and Hamilton LLP was also appointed international legal adviser, while Lazard Freres will be the financial adviser.

International banking representatives will discuss the scheme Thursday during talks in Athens with finance ministry officials.

Book Review: The Juice | VFTB

The complete title of this book is ?The Juice ? The Real Story Of Baseball?s Drug Problems?. It was written by Will Carroll, with William L. Carroll, Ed.D., and Foreword by Alan Schwarz. It was published in 2005.

The following synopsis is located on the back cover: ???The Juice? offers a wide-ranging investigation of the drugs now being used or contemplated, the athletes who use them, their scientific effects and side effects, the testing procedures, and the impact of drugs on game performance. Will Carroll?also explores the grey area of legal supplements, reviews the law involved in the BALCO case, and speculates on the next generation of performance enhancers that may well include gene therapy. In exclusive interviews he profiles the motives and experiences of professional players, student athletes, and drug creators.?

That just about covers it.

In the Introduction author Will Carroll, in describing his motivation for writing ?The Juice?, quotes Alan Schwarz: ??I wrote the book because I wanted to read it. It would have been much easier for me to have gone to the bookstore and bought it, but it wasn?t there.? ?the material that follows is something I could not find, yet wanted to see in print.?

There is information included in ?The Juice? that I was not aware of, and didn?t even suspect.

Rob Neyer, of ESPN, is quoted on the front cover: ?Don?t say another word about ?steroids? until you?ve read ?The Juice?.?

Not too long ago I read an on line discussion about the use of Performance Enhancing Drugs (PEDs) in baseball. This was just as I was beginning to read ?The Juice?. Gee, all of the points people were getting at in that discussion are presented, clarified &/or answered in ?The Juice?.

Along those lines, Allen Barra is quoted on the back cover, thusly: ?Everyone talks about steroids, but no one knows anything about them. Will Carroll?s ?The Juice? is the first step in our education.? I found Mr. Barra?s quote to be very accurate.

In the Foreword, Alan Schwarz opines: ?What Will brings to the steroids issue is calm, measured analysis of a subject that too often drowns in sanctimonious pap.? Once again, a very accurate description of this book.

I found the chapters featuring profiles of various participants in this drama (the player, the tester, the student, and the creator) to be of particular interest. Very enlightening.

Similarly, the chapter titled: ?Pre-trial Commotion: The Legal Issues of Steroids and Sports?, which was prepared with the help of Pat Cotter, a white-collar criminal defense attorney from Chicago, I found to be extremely enlightening.

Here are a few of my favorite quotes, from the book:

- ??the issue was never about science, it was about emotion.?

- ?Assumption is the marshal of this parade. Fact is stuck somewhere in the back of the ranks.?

Florida court upholds $30 million tobacco award (Reuters)

MIAMI (Reuters) ? The Florida Supreme Court on Tuesday upheld a jury's order that the R.J. Reynolds Tobacco Co pay nearly $30 million to a woman whose husband died of lung cancer after decades of smoking its cigarettes.

The court issued a brief ruling saying it would not review the product liability award nor entertain any further motions for rehearing. The tobacco company, a unit of Reynolds American Inc, argued the award was excessive.

The ruling could affect thousands of pending cases.

In 2009, a state court jury in Pensacola, Florida, ordered Reynolds to pay more than $3.3 million in compensatory damages and $25 million in punitive damages to Mathilde Martin. Her husband, Benny Martin, died in 1995 of lung cancer that she blamed on his long-time smoking of Reynolds' "Lucky Strike" cigarettes.

The jury said Reynolds was 66 percent responsible for Benny Martin's death and that Martin, who started smoking in the 1940s before health warnings were added to cigarette packages, was 34 percent responsible.

The award was the by far the largest to date among the "Engle progeny" cases filed against tobacco companies by sick Florida smokers or their relatives. The cases stem from a landmark 1994 class-action lawsuit filed by a pediatrician, the late Dr. Howard Engle, that produced a $145 billion judgment against cigarette makers six years later.

The Florida Supreme Court overturned the Engle award in 2006 and ruled that Florida's ailing smokers could not sue as a class, or group.

But it made it easier for them to sue individually by upholding the trial jury's findings that smoking causes disease, that nicotine is addictive, that cigarettes are defective and dangerous, and that tobacco companies concealed the health effects of smoking. Thousands of individual cases are still pending in Florida.
